Definitions

• "Transfer" means a booked vehicle transportation service from a pickup location to a drop-off location.
• "Carrier" means a registered vehicle owner or fleet manager who provides vehicles and drivers through our platform.
• "Driver" means a licensed professional chauffeur assigned by a Carrier to carry out a Transfer.
• "Passenger" means any individual traveling in a booked vehicle during a Transfer.
• "Booking" means a confirmed reservation for a Transfer made through our platform.
• "Agency Account" means a registered business account used to book Transfers on behalf of employees or clients.

Account Registration and Eligibility

To use certain features of our Services, you must create an account. By registering, you agree to:

• Be at least 18 years of age
• Provide accurate, complete, and current information during registration
• Maintain the confidentiality of your login credentials
• Accept responsibility for all activities conducted under your account
• Promptly notify us of any unauthorized access to your account

We reserve the right to suspend or terminate accounts that provide false information, engage in fraudulent activity, or violate these Terms. Accounts may be locked after multiple failed login attempts as a security measure.

Booking and Transfer Services

Our booking process follows a multi-step flow: route selection, vehicle selection, passenger details, and payment. By completing a Booking, you agree to the following:

• All Bookings must be placed at least 12 hours before the scheduled departure time
• Prices are calculated based on distance, vehicle category, selected features, and applicable bridge tolls (Istanbul Bosphorus, Çanakkale)
• Quoted prices include VAT unless otherwise stated
• A unique confirmation number (LMN prefix) will be issued for each confirmed Booking
• You are responsible for providing accurate pickup/drop-off locations and passenger information
• Vehicle availability is subject to scheduling, blocked times, and buffer periods between transfers

We act as a platform connecting you with independent Carriers. While we facilitate Bookings and process payments, the Transfer service itself is provided by the assigned Carrier and Driver.

Pricing and Payment

All payments are processed securely through Garanti BBVA Virtual POS with 3D Secure authentication. By making a payment, you agree to the following:

• Payment must be completed at the time of Booking unless a pay-later option (payment link) is provided
• We accept major credit and debit cards. All card transactions are authenticated through 3D Secure for your protection.
• We do not store your full card details on our servers. Payment data is transmitted directly to the payment processor.
• Agency accounts may be eligible for negotiated discount rates on vehicle prices and optional features
• Prices are displayed in Turkish Lira (TRY) unless otherwise indicated
• Cash payment may be accepted for certain transfers when arranged in advance and confirmed by the Carrier

Cancellation and Refund Policy

You may cancel a confirmed Booking subject to the following conditions:

• More than 48 hours before departure: Full refund of the booking amount.
• 24 to 48 hours before departure: Partial refund. The refund percentage is calculated based on the time remaining until departure.
• Less than 24 hours before departure: No refund is provided for last-minute cancellations.

Refunds are processed through the original payment method and may take 5-10 business days to appear in your account. The exact refund amount will be shown in the cancellation preview before you confirm.

We reserve the right to cancel a Booking due to extraordinary circumstances (severe weather, road closures, vehicle breakdowns, force majeure). In such cases, a full refund or rebooking will be offered.

No-Show Policy

A "No-Show" occurs when the Passenger fails to appear at the designated pickup location within the agreed waiting time. In the event of a No-Show:

• The Driver and Carrier will attempt to contact the Passenger using the provided contact details
• If the Passenger cannot be reached within the designated waiting period, the transfer will be marked as a No-Show
• No refund is provided for No-Show bookings. A penalty fee may apply as configured in our system settings.
• The Carrier is entitled to compensation for the No-Show as per the agreed commission structure

Passenger Responsibilities

By using our Transfer services, Passengers agree to:

• Be present at the pickup location at the scheduled time
• Treat the vehicle, equipment, and Driver with respect
• Wear seatbelts at all times during the Transfer
• Not consume alcohol, smoke, or use illegal substances inside the vehicle
• Not bring hazardous materials, weapons, or illegal items into the vehicle
• Be responsible for any damage caused to the vehicle during the Transfer
• Ensure all passenger information provided during booking is accurate
• Follow the Driver's reasonable instructions regarding safety

We reserve the right to refuse service or terminate a Transfer in progress if a Passenger's behavior poses a risk to safety or violates these Terms. No refund will be provided in such cases.

Carrier and Driver Terms

Carriers and Drivers using our platform agree to the following additional terms:

• Complete the identity verification process and provide valid licenses and documentation
• Maintain vehicles in excellent condition, with current insurance and inspection certificates
• Confirm or decline assigned Transfers promptly within the platform
• Provide professional, courteous, and safe transportation services
• Arrive at pickup locations on time and follow the designated route
• Earnings are calculated based on the agreed commission structure and tracked through the platform
• Withdrawal requests are subject to minimum balance requirements and processing times
• Carriers are independent contractors, not employees of Limousinium

Intellectual Property

All content on our website and application — including text, graphics, logos, icons, images, audio, software, and the overall design — is the property of Limousinium or its licensors and is protected by Turkish and international intellectual property laws.

You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any of our content without prior written consent from Limousinium.

Limitation of Liability

To the maximum extent permitted by applicable law:

• Limousinium acts as a platform connecting Users with independent Carriers and is not directly liable for the performance of Transfer services
• We are not responsible for delays, cancellations, or service issues caused by factors beyond our control, including but not limited to traffic, weather, road conditions, or government actions
• Our total liability for any claim arising from your use of the Services shall not exceed the amount you paid for the specific Booking in question
• We are not liable for indirect, incidental, consequential, or punitive damages arising from the use or inability to use our Services
• We make no warranties, express or implied, regarding the availability, accuracy, or reliability of third-party services integrated with our platform (mapping, payment processing)

Indemnification

You agree to indemnify, defend, and hold harmless Limousinium, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using the Services for any unlawful purpose or in violation of applicable laws
• Attempting to gain unauthorized access to our systems, databases, or other users' accounts
• Interfering with or disrupting the operation of the Services or servers
• Using automated scripts, bots, or scrapers to access or extract data from our platform
• Impersonating another person or entity, or providing false information
• Using the platform to transmit malicious software, spam, or harmful content
• Making fraudulent Bookings or using stolen payment methods
• Circumventing or manipulating the pricing, commission, or discount systems

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising from or relating to these Terms or the use of our Services shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.

Before initiating legal proceedings, the parties agree to attempt to resolve disputes through good-faith negotiation. If a resolution cannot be reached within 30 days, either party may pursue legal remedies.

Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated Effective Date. Material changes will be communicated to registered users via email or in-app notification. Your continued use of the Services after such modifications constitutes acceptance of the updated Terms. If you do not agree with the changes, you must discontinue use of the Services.

Severability and Entire Agreement

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Limousinium regarding the use of our Services, superseding any prior agreements or understandings.
